The user acknowledges that he/she has read these General Terms and Conditions of Use and undertakes to comply with them.

The aim of this site is to host the scientific and technical materials produced by researchers and lecturer-researchers of the UMR (Mixed Research Unit) and EA (Host Research Team) affiliated to five Higher education institutions on the Bordeaux site: The University of Bordeaux, The University of Bordeaux Montaigne, the Institute of Political Science of Bordeaux (IEP), the National Polytechnic Institute of Bordeaux (Bordeaux INP), and the Bordeaux Institute of Agricultural Sciences (Bordeaux Sciences Agro).

The content of the website is provided "as is", without any form of guarantee whatsoever. Any information provided by the website is for information only and may not exempt users from performing their own additional analyses tailored to their personal needs. The University of Bordeaux may not guarantee the accuracy, completeness or topicality of the information disseminated on its website. Consequently, users assume sole liability for the use of this information.

This website may permit the creation of links to existing website or sites hosted by third parties.

In the context of service provision offered by this website , the University of Bordeaux recognizes the need to comply with existing personal Data Protection Laws and legislation in accordance: with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, with the French Data Protection Act no. 78-17 of 6 January 1978, as amended relating to data processing, files and personal freedom and privacy, and with the French Law No 2018-493 of 20 June 2018 on personal data protection.

As service provider the university is responsible of the personal data processing collected in terms of this contract. The collected data are limited to:

  • The author’s name and qualifications, his academic affiliation, and eventually including his photo;
  • A set of metadata in accordance with the Dublin Core standard (www.ietf.org/rfc/rfc2413.txt). .

Personal data are only collected for the specific purposes of publication, referencing and indexing of the author's scientific output, and typically through the creation of bibliographic records.

These data will be stored for as long as the research material is published on the website. The removal of a publication by the author would lead to the elimination of the related data. The removal of all the material would lead to the total deletion of the author’s related data.

The author acknowledges that the deposited material may be web-harvested by search engines specialized or not in the indexation of Open Archives, and that he consents the visibility and use of the extracted bibliographic data.

The website user's personal data will not be processed. Each user may choose to fill in a contact form, apply for a copy request, or aggregate RSS-Feeds. All data submitted by the users are used only to respond to their request, and will not be used for any other purpose. Data are kept only for the necessary time required to process the request.

The personal data collected by the University of Bordeaux will not be submitted to any systematic processing.

Cookies

The site does not use cookies to track or identify the users. The cookies are only stored to save information related to the user's browsing on the website.

This website uses two types of cookies:

  • • A cookie proper to the software used for authentication and session management (JSESSIONID). This cookie applies only to the five above-mentioned university institutions staff, who currently have a valid Digital ID attached to their institution, and which allows them access to the repository interface
  • • A specific cookie to "ShareThis" a software that manages sharing on social networks. This cookie concerns users who share materials published on the website on social networks.

Site users acknowledge to have been informed about this practice and authorize it.

The university reminds users that they are responsible for the safety of their registered ID and password. It may not be held responsible for any fraudulent use of identifiers, in case of disclosure to a third party.

Intellectual Property Rights to deposited material and License to Use

The University of Bordeaux draws the user’s attention that the content and material published on the website are protected by copyright and intellectual property law, in accordance with the French intellectual property code.

Users:

  • shall cite the source of the work, and quote the name of the authors, for any reproduction, in whole or in part
  • may create a hyperlink to the materiel available on the website
  • shall not modify, transform or adapt the work without the explicit consent of the author
  • shall not use the work for any commercial purposes
  • shall not use the work in any manner which could impair the work or interfere with any other party's possible usages of the work

The author's consent must be obtained before the use of the whole or a part of a work, not falling under the private copying regime within the meaning of art L122-5-2° of the French code of the intellectual Property, or for public research purposes (art L 122-510° code of the intellectual Property). Any person infringing this provision shall be liable to the penalties provided for by this law.

If an author wants to share his work under a specific Creative Commons license, he retains all of the copyrights associated with his work, and defines the level of reuse, that are not fixed by these Conditions of use. The users may reuse then all or part of the material according to the chosen Creative Commons licence.

The intellectual property rights of the Website and metadata

Oskar trademark and www.oskar-bordeaux.fr domain (“the Website”) are the property of the University of Bordeaux and have been registered at the French National Institute for Intellectual Property (Institut National de la Propriété Intellectuelle - INPI).

The Website database and metadata records are also the exclusive property of the University of Bordeaux, and are available under Open License.

Applicable law and competent courts

Any dispute relating to the use of this website and/or its contents shall be subject to the French law and the exclusive competence of the Bordeaux courts.
